The overall aim of this course is to give students a thorough understanding of the fundamental principles of Administrative Law in Ireland. It will provide the student with an in-depth examination of the rules which regulate the conduct of an administrative body as well as the principal remedies available for the correction of a breach of those rules.
On completion of this programme, students should be able to:
• Define and describe the main rules of administrative law;
• Identify and explain the principles of constitutional justice;
• Explain and apply the rules, practices and procedures of judicial review of administrative action;
• Distinguish between, and critically appraise, the remedies available by way of judicial review;
• Compare and contrast the development of certain rules of administrative law and their application within this and other jurisdictions;
• Critically evaluate the impact of the European Convention on Human Rights Act 2003 on public bodies in the performance of their functions;
• Apply the rules of administrative law to hypothetical problem scenarios and give an account of relevant case-law, legislation and policy in relation to the issues raised.
